Adam Hersh, Esquire, is a multi-state licensed attorney and certified mediator with a passion to protect, defend, and advocate for his clients. Adam divides his practice between commercial litigation and contract negotiations. Within the firm, Adam is called upon to find creative solutions to complex problems. Whether his clients are having a problem with a creditor, a debtor, a former employee, a business partner, or some other disruptive force, Adam is driven to solve their problem.

Adam got his start in the business world as in-house corporate counsel for AxoGen, Inc., a start-up medical device company that is now a publicly traded company. At AxoGen, Adam worked inside of a business incubator hub, working with the company’s business executives on a daily basis to address various legal needs. Adam knows how crucial it is to balance the business and legal sides of every business transaction. In addition, Adam worked in the United States Bankruptcy Court for the Honorable John K. Olson, where he assisted in restructuring businesses through the bankruptcy court.

Client Engagement Highlights

  • Successfully mitigated a public nuisance dispute on behalf of the commercial property owner, resulting in an emergency evidentiary hearing judgment in their favor, and therefore, preventing the loss of the property’s desirable zoning designation – a value of several hundred thousand dollars – due to the actions of the tenant.
  • Represented the owner of a Tampa-based championship-winning auto racing team during a litigation dispute over a false allegation of stolen property, resulting in the court entering a judgment in my client’s favor on all claims, and awarding our client damages.
  • Resolving a customer dispute, as General Counsel to a local business owner, regarding a lawsuit claiming damages of nearly $500,000, in a manner which resulted in all parties where happy and felt their needs were met.
  • Successfully obtained a judgment in excess of six figures on behalf of a multi-state business owner, inclusive of attorney fees and court costs.
  • Successfully defended against members of limited liability company attempting to appoint a receiver to take over and shutdown our Client’s business.
  • Successfully defended against the enforcement of a personal guarantee of approximately $300,000.00, as well as obtained a judgment for attorney fees and court costs.
  • Lead counsel in a prevailing arbitration action striking a punitive liquidated damages clause from being used against a local business, as well as shielding the business owners themselves from personal liability.
